The unclean hands doctrine is an equitable defense that arises when the party seeking specific performance is guilty of some wrongdoing in the transaction being sued upon (e.g., the defendant entered into the contract because of the plaintiff’s lies). Note that the wrongdoing must be related to the transaction being sued upon; it isn’t sufficient that the plaintiff has defrauded other persons in similar transactions.
Unclean hands on the part of the plaintiff is often pleaded as an affirmative defense by the defendant. Whenever a plaintiff has an equitable remedy (like specific performance), the defendant can generally raise an equitable defense. The most frequently claimed equitable defenses are unclean hands, laches, and sale to a bona fide purchaser.
